Anti-Second Amendment Lawyer Doesn't Get the Basics of Law By Rizzuto Mon Mar 17, 2008 - The Supreme Court will once again hear a challenge to the District of Columbia’s gun ban. I love how leftist lawyers don't even understand the most basic constitutional concepts. We’re really fu**ed if these are the people with whom we’re entrusting our constitutional rights. From the LA Times: [Dennis] Henigan, [a] Brady Center lawyer, compares guns to automobiles. Americans have a legal right to own a car and drive on the highway, but they must also obtain a state driver's license and abide by speed limits, and the vehicle must pass a safety inspection.Ok there slick, can you please point me in the direction of the amendment that provides for the limitation of the government from infringing on the right to "keep and bear automobile"? Oh, it's not there, therefore the power to regulate automobiles falls upon the state in accordance with the 10th amendment. This is a basic and core concept I suppose they don't teach in law school anymore. On the other hand, libertarian lawyer Robert A. Levy hits the nail on the head when he says: "Whenever there is an individual right [protected by the Constitution], the burden is on the government to justify a limit on that right."In other words, it's not my burden to explain why I should be able to own a gun, but rather the governments burden to explain why i shouldn't. Apparently, Brady Center lawyer Dennis Henigan will be taking the side of government in the case of The People vs. overreaching, unconstitutional regulation.
